1. Design Approval / Client Sign-Off
Production will only commence following receipt of written approval of all drawings, specifications, artwork and deposit payments. Any errors or omissions identified after approval become the responsibility of the client.
2. Design Changes & Variations
Any design changes requested after approval may result in additional charges and revised lead times.
3. Dimensions & Tolerances
Due to the bespoke nature of our products, dimensions may vary within standard manufacturing tolerances.
4. Site Measurements
Unless a site survey has been carried out by All Creative Elementz, all dimensions supplied by the client are assumed to be accurate.
5. Installation Conditions
Installation times may be affected by site access restrictions, loading limitations, venue rules, security procedures or delays caused by third parties.
6. Client Delays
Delays in providing approvals, artwork, measurements, access information or deposits may impact agreed project timelines.
7. Colour Matching
Exact colour matching cannot be guaranteed due to differences in materials, finishes, print processes and lighting conditions.
8. Natural Material Variations
Natural materials may vary in grain, texture, colour and appearance and are not considered defects.
9. Ownership Until Payment
All goods remain the property of All Creative Elementz until paid for in full.
10. Photography Rights
Unless otherwise agreed in writing, All Creative Elementz reserves the right to photograph completed projects and use such images for marketing and portfolio purposes.
11. Damage After Handover
Responsibility for the project transfers to the client upon delivery, collection or completion of installation.
12. Storage Charges
Storage charges may apply where completed items cannot be delivered or collected as scheduled.
13. Force Majeure
The Company shall not be liable for delays caused by circumstances beyond its reasonable control.
14. Payment Terms
50% deposit to commence production.
Remaining balance due before delivery or installation.
Ownership remains with All Creative Elementz until full payment is received.
15. Abandoned Projects
Projects placed on hold by the client for more than 30 days may be subject to revised pricing and lead times.
16. Rush Orders / Short Notice Projects
Rush Orders & Short Notice Projects
Projects confirmed with less than 10 working days prior to the required delivery or installation date shall be considered Rush Orders.
Whilst All Creative Elementz will make every reasonable effort to meet the requested delivery or installation date, all dates provided for Rush Orders shall be considered target dates rather than guaranteed deadlines.
Rush Orders are accepted on a best-efforts basis and are subject to material availability, supplier lead times, production capacity, transport availability and site conditions.
Where production time is significantly reduced due to late approval, late deposit payment, delayed client responses, incomplete project information, design changes or other circumstances outside of All Creative Elementz's control, the Company reserves the right to:
utilise alternative materials, finishes or components of comparable quality and appearance where originally specified items are unavailable within the available timeframe;
amend manufacturing methods where reasonably necessary to achieve the requested deadline;
deliver items in a partially completed state where minor finishing works can be completed on-site;
revise delivery, installation or completion schedules as required.
The Client acknowledges that reduced lead times increase the likelihood of programme adjustments and accepts that All Creative Elementz shall not be liable for delays, additional costs, losses, missed event deadlines or consequential damages arising directly or indirectly from the shortened production schedule.
17. International Deliveries, Customs & ATA Carnets
International Deliveries, Customs, ATA Carnets & Logistics
Where projects involve international transportation, customs clearance, ATA Carnets, freight services or cross-border logistics, all delivery, installation and collection dates are provided in good faith and are subject to customs procedures, border controls, inspections, transport disruptions and other factors beyond the Company's reasonable control.
Whilst All Creative Elementz will make every reasonable effort to prepare, process and submit all required documentation accurately and on time, delivery and installation dates shall be considered target dates rather than guaranteed deadlines.
The Company shall not be liable for delays, additional costs, missed deadlines, event disruptions or consequential losses resulting from:
customs inspections or interventions;
border delays;
ATA Carnet processing, verification or customs procedures;
import or export restrictions;
actions of customs authorities, border agencies or government bodies;
transport provider delays;
adverse weather conditions, strikes, port congestion or transport disruption;
inaccurate, incomplete or late information supplied by the Client;
delayed approvals, documentation or payments from the Client.
Where transport, customs documentation, ATA Carnets or logistics services are arranged on behalf of the Client, all deposits and payments made towards such services may be used to secure administration, documentation, bookings, transport capacity and third-party services.
In the event of cancellation, postponement, failure to provide required information, delayed approvals, delayed payments or any other action or omission by the Client which prevents or delays completion of the transport or logistics service, All Creative Elementz reserves the right to retain all costs already incurred together with any non-refundable or non-recoverable third-party charges.
Any refundable balance remaining after deduction of such costs shall be returned to the Client.
Any additional costs arising from customs inspections, storage charges, demurrage, duties, taxes, penalties, transport delays, re-delivery, re-booking fees or other border-related matters shall remain the responsibility of the Client unless otherwise agreed in writing.
The Client shall remain liable for all costs reasonably incurred by All Creative Elementz as a result of the Client's actions, delays, omissions or failure to provide required information within the requested timeframe.
